For a Jewish person considering divorce, a civil divorce is not enough. In Jewish law, marriage and divorce laws apply to all Jews, irrespective of religious conviction. Without a Get, a Jew may not be able to remarry within the Jewish faith. It will have serious implications for both parties and their future families. It is therefore in the best interests of all concerned to obtain a Get. If you’re getting divorced Contact your local Beth Din (see below). and then to speak to your solicitor, as you can ask your solicitor to include a Get clause in your divorce. If your spouse is not co-operating with obtaining the Get, ask your solicitor to help you by using the Divorce (Religious Marriages) Act 2002 before decree absolute. Ask your solicitor also to read the legal articles published in the Family Law Journal, to which there is a link at www.gettingyourget.co.uk . If you’re a solicitor Insert a Get clause into the consent order for the English Courts. This will help prevent later refusals or demands in the granting of the Get by one or other of the divorcing parties. If your client’s spouse is not co-operating with obtaining the Get, you can help by invoking the Divorce (Religious Marriages) Act 2002 before decree absolute.
